A reconsideration request is a written letter to IRCC (or CBSA, if applicable) asking them to review and reverse the decision on your file, usually due to:

  • Officer error or misunderstanding
  • Missing or misinterpreted documents
  • Unfair or unreasonable decision
  • New compelling evidence (that was not available at time of application)

  2. Date of refusal
  3. Clear explanation of the error/misunderstanding
  4. Correct or missing evidence
  5. Polite and respectful tone
  6. Supporting    documents, if any

🔄 Alternative Options if Reconsideration Fails

  2. Judicial Review (Federal Court)
    • If decision is unfair or unreasonable
    • Must file within 15 or 60 days depending on location

🛠️ Pro Tip:

You can order your GCMS/CAIPS notes to understand exactly why the application was refused. This helps before you reapply or request reconsideration.

🔁 Inadmissibility

Fighting inadmissibility to Canada depends on the reason you're considered inadmissible. Inadmissibility means you're not allowed to enter or stay in Canada due to certain legal, medical, or security concerns. However, there are legal ways to challenge, overcome, or get an exemption from inadmissibility.

🛑 Grounds of Inadmissibility in Canada

You may be found inadmissible for reasons such as:

  1. Criminal Inadmissibility (e.g., DUI, theft, assault)
  2. Misrepresentation     (e.g., false documents, hidden facts)
  3. Medical Inadmissibility (danger to public health or excessive demand)
  4. Security Grounds (e.g., terrorism, espionage)
  5. Financial Reasons (inability to support oneself)
  6. Human Rights Violations
  7. Inadmissible Family Member
  8. Non-compliance with IRPA (e.g., overstaying, unauthorized work)

🔧 How to Fight or Overcome Inadmissibility

1. 🔁 Apply for Criminal Rehabilitation

  • For foreign nationals with past criminal convictions.
  • You may be eligible 5 or 10 years after completing your sentence.
  • Once approved, you are no longer inadmissible for those offences.

👉 Best for: DUI, theft, assault, fraud, etc.

2. 📄 Temporary Resident Permit (TRP)

  • Allows you to enter/stay in Canada temporarily despite being inadmissible.
  • You must show a compelling reason to enter (e.g., business, family      emergency).

👉 Valid from 1 day to 3 years, depending on case strength.

3. ⚖️ Appeal to the Immigration Appeal Division (IAD)

  • For permanent residents or sponsored family members.
  • You can appeal a removal order or refusal if eligible.
  • Must file within 30 days of receiving decision.

4. 🏛️ Judicial Review in Federal Court

  • If you believe the decision was procedurally unfair or legally incorrect,      you can challenge it.
  • File for Leave and Judicial Review within 15–60 days.

👉 You cannot submit new evidence, only argue on legal basis.

5. ❤️ Humanitarian & Compassionate (H&C) Grounds

  • If you are inadmissible but removal would cause extreme hardship, you can apply for PR under H&C.
  • Can  be based on:
    • Best interests of children
    • Establishment in Canada
    • Health or family issues

6. 📋 Pre-Removal Risk Assessment (PRRA)

  • For people facing removal/deportation.
  • Assesses if you'll face torture, persecution, or danger in home country.
  • Only available in certain conditions.

🔁CAIPS:

✅ What Are CAIPS Notes?

CAIPS (used for paper-based applications) and GCMS (Global Case Management System) notes (used for most current applications) contain:

  • Full history of your visa application
  • Officer's internal notes and comments
  • Reason for refusal or delay
  • Eligibility,  background, and security check status
  • Details of submitted documents and interview notes

➡️ CAIPS was mainly used before 2010; today most applicants request GCMS notes, but the term CAIPS is still commonly used to refer to both.

📌 Why Request CAIPS/GCMS Notes?

  • Understand why your application was refused
  • Plan a stronger reapplication or reconsideration
  • Prepare a judicial review or appeal
  • Check the status of a pending application
  • Discover if there's any ineligibility or misinterpretation

🧾 Who Can Request CAIPS Notes?

Only:

  1. You, if you're in Canada and a Canadian citizen/PR, OR
  2. A representative      inside Canada (lawyer or consultant), with your consent form (IMM 5475).

📝 How to Apply for CAIPS/GCMS Notes

  1. Fill Consent Form IMM 5475
  2. Apply via:
    • ATIP  (Access to Information and Privacy) request at IRCC’s ATIP portal
    • Or       hire a licensed representative to file it for you

  1. Pay $5 CAD fee (online)

⏳ Processing time: Usually 30–40 days

🔁Removal Order Extension – Canada

A Removal Order Extension is a request to delay or defer your removal (deportation) from Canada, usually issued by the Canada Border Services Agency (CBSA) when you’ve received a:

  • Departure Order: Must leave Canada within 30 days, confirm departure.
  • Exclusion Order: Barred from Canada for 1 year (or 5 years for   misrepresentation), or
  • Deportation Order: Permanent removal due to serious reasons.

You can apply to CBSA to postpone your removal if you have valid humanitarian, legal, or medical reasons.

📝 When Can You Request an Extension?

You must show valid, time-sensitive reasons, such as:

  • Medical conditions (your own or a dependent's)
  • Pending immigration application (H&C, PRRA, spousal sponsorship, etc.)
  • Upcoming surgery or childbirth
  • Children’s education or exam period
  • Family hardship
  • Lack of travel documents (e.g., passport not issued yet)

📄 How to Request a Removal Order Extension

Step 1: Prepare a Written Request

Your letter must include:

  • Your full name, UCI, and copy of removal order
  • Reason for extension, with proof
  • How long of a delay you are requesting
  • Supporting documents (e.g., medical letters, school proof, legal applications)

Step 2: Submit to CBSA

  • Contact  your local CBSA Enforcement office
  • Submit in person or by email, depending on local procedures
  • You  may be called in for an interview

⚠️ Important Notes

  • CBSA is not required to approve the extension. It's discretionary.
  • If denied, you must comply or face detention and forced removal.
  • Extensions are usually short-term (weeks or a few months).
